I feel you and your children should get more. But unfortunately the courts dont recognize any difference between children born from a marriage or outside. So if she files first, she will get the first percentage (20%) even though u were married with 3 kids. After that is subtracted, they will take around 35% of the remainder for your kids. The kids from marriage should be recognized first and the courts should respect this.

Each state and county is different. Generally, child support is based on how much money he makes. If there are two support orders (yours and hers) they are both considered. The support is figured per child. If you have 3, you'll get more than she does because she only has one.

your children will get the larger portion (since more money will be collected in your home)--- go file for child support since you two aren't going to be together - you stated "we are separated"....
According to the on line resource(divorce net) four kids (the total of the kids he'll be supporting) collect roughly 40% of his average monthly pay(each one gets same amount).... and he maintains the kids on his insurance.

Here they will take the amount he pays and divide that by 4 so each child gets the same amount.
