Probably not.

First of all, the state generally has sovereign immunity. That's quite a hurdle to get over, and takes a lot of time better spent doing absolutely anything other than tilting at a windmill.

Second, states have really really deep pockets. If the case is won, the award can be huge. Why make someone rich for free?

On contingency, MAYBE. Pro bono, forget it.

Most states got tired of frivolous law suits by inmates in their corrections systems. A lot of them are re-inacting or trying to exhume sovereign immunity statues that were from the nineteenth century.......maybe the eighteenth. The case would have to be as solid as a crankshaft on a Greyhound bus, if they went for the bono........they would do plenty of research, they would make sure there were enough ZERO'S.......LATER
