Apparently the police told her she could serve then with a 15 day notice. I have never heard of such a thing. I fear they will not evict properly. I have researched and these people are professional evictees. Just yesterday the owners son tried to enter the property while the neighbors were not there. Any advice would be greatly appreciated as I want this scum GONE!

Yes I do understand that they can absolutely be evicted for conducting illegal activity. I just thought in California there was only a 30 day notice if month to month or 90 day notice if lease. The owner is saying they are giving 15 days and I can't find any reference to that in the law. I just wondered if this is something the police do? The police have notified the owner if they do not convict they will take the property. And by professional evictees I mean that I have searched these people on the net and they have been evicted from every place they have lived in the last 10 years! They don't leave till the sherrif comes knocking. The owners are naive and, quite frankly stupid. I fear they will screw it up and those renters will know it and sit as long as possible. Anyone know what a 908 letter is? That's what the police told me they sent to the landlord?

The law's the law even if it doesn't sound or seem right. The landlord has to wait out the 15days notice. If they don't move, they can file paper with the court and have the cops come and take care of that.

It depends on what country you are in. If in the US - landlord/tenant right might even vary state by state.
In the UK, for certain offences IF the property itself was involved (dealing drugs from flat etc), then posession can take place without the usual drama of court orders / evictions etc.
Still best to get a legal guy to oversee, but in the UK, it can be done under special conditions the second the landlord or his agent can get to the flat!
The property itself MUST have been involved in the crime however if I remember correctly - otherwise you are stuck with the usual rigmarole unless a VERY serious crime.
I would bother to check my facts but as it probably doesn't apply to you, there isn't much point. PLEASE let folks know where you are when asking questions which might depend on the law etc.

Laws differ in different counties, but if the said "Tenants" who was arrested violated any of the terms signed in their "lease or rental agreement" the landlord could evict them for breach of contract, if they signed a contract with the landlord.
In this case, it would be to the best interest for the landlord to evict them immediately, because the D.A could cease the property if these people get convicted of selling drugs, or weapons from that property.
If there are any "quality of life" clauses in the contract, and if I owned the property, I would go to the D.A who had them arrested, to get them evicted while they are in jail.
The landlord will need a court order to do this, and would have to file it immediately

Every state has different laws regarding eviction, go to your local courthouse and get a copy of the Landlord Tenant act and it will give you the information you are seeking.

The landlord and the police know how to do it. In most rental contracts, the contract is void if you do illegal activity on the premises I think, your landlord will get rid of them.

Yes, you can evict someone who is conducting illegal activity on your property. First almost every rental agreement has it in its clauses.
