You may want to protect yourself and your kids with a restraining order before he is let out. Especially if you are going to lay a heavy trip like this on him. He is expecting to have a warm welcome when he gets out and he hasn't exactly been spending time in a very friendly place. Who knows what kind of company he's been keeping.
You have the privilege of choice, but you need to move in a smart safe way for you and children--first thing get a lawyer! Don't make the same mistake as me, going to court representing myself and getting eaten alive by a 'shark' lady lawyer from h.e.l.l.

I really don’t think you have anything to worry about in most cases the courts still favor the mother. There is a lot going against your soon to be ex-husband. Drug charges, the fact he left his family several times, he has not paid his child support. I very much doubt any judge would give this man sole custody. Ask yourself do you really want to be talking to a man in prisons. Sorry to say but most people who go to the big house will keep going back. That said even talking to this man I don’t think would get the courts to take custody away from you. Though that could depend why he (the guy your talking to) is in the jail. However I really don’t think your husband would be consider being best to have full custody of the kids, so they’d likely end up in foster care or some other relative would take guardianship.

What??!! Where have you been?? Divorces take more than a week or two, lady.......try a year or so.
You've got problems. Are you not going to let him back into the house? Are you going to try to keep him away from the kids? He's probably a drug addict........no telling what frame of mind he's in now that he's getting out.

Go to a lawyer before he gets out. I don't understand why you didn't do this while he was in jail. Your chances of getting full custody while he was in jail was better. In most countries, you don't need permission from your spouse to get a divorce.

easy... see a lawyer and get the lawyer to write him a letter to be sent to the prison
you WILL get your divorce and you WILL get your custody... the courts will never deny you of custody of the kids, especially cos your husband is a convicted criminal
