Depends on the age. By definition, it is statutory rape. If a person is legally a minor, anyone old enough to be a legal adult cannot have sex with that person.
We do have the double standard of female teachers getting probation for having sex with a minor boy, but throwing the book at males who do the same.

The only legal way around this would be if a couple was married and one person was over 18 and the other was under 18. Otherwise, it's statutory rape.

In almost all states and many counties, any sex with a minor is presumed to be non-consenting, because the minor is considered not able to consent to have sex with an adult.
