If his time is over, you win. As his opponent, you can make him aware of the fact his time is up. You usually simply say "Time", and maybe point to the clock. Whatever happens after time is passed (even checkmate) is irrelevant. As soon as that flag goes down, your opponent loses on time. If it's a tournament situation and your opponent refuses to acknowledge the time loss, you should refer the matter to the tournament referee or organizer.

Are you playing at an advanced chess site. If so, then your oponets connection must be bad but the "great" chess site wants to make everybody happy by correcting it. So, your opponet is using less time then you think. It's just that his connections bad. Try playing at a lesser sight if that bothers you.
