It's a very old symbolic tradition. Once a pen has recorded the death sentence for a prisoner, the pen should not record any other sentence. Just as the death sentence is final, nothing afterwards matters.

In modern days, the tradition has been pretty much abandoned.

Well, it is shown, in movies. But,not on hearing, only on awarding or proclaiming, a death sentence. However, I doubt, it ever happens in real life. These days, very few people use fountain pens. Those who use, they are costly ones, like PARKER and all. No body will have heart, to break them

The convict might get wild, break free and push the nib in the judge's eyes. By the way are you sure judges never use ball point pens?

I've been an attorney since 1993 and I've never heard of such a practice. In fact, I've never seen a judge ever use gavel except on TV.

could be that judges are really slack and lazy.. and they are just trying to make an excuse that they got cramps in thier hands and wanna chuck a sickie ( take the day off ) the next day . :)

beaking of pen nib symbolises no more use of that pen as well as life of that prisoner

Sentiment.If it is used for another judgement it may also be a death sentence.
May be they express their feeling that they are sorry to give that severe judgement.
