My friends mom called the other day becuase of me and my friends argument. Me and my friend already talked about and where fine again. but her mom called and it sorta made more turmoil and later on I found out that she recordied her and my moms phone conversation with out my mothers consent, that is illegal right? Its not like cops where involved and recording a rapist confess or something so I thought that its not legal and our parents had nothing to do with the argument and it was a stupid fight so why would she even record it?

I live in NY and the argument was becuse my friend said my parents are alcoholics(which they are not i know what an alcohlic is they do NOT come close) and she also said a few other things that when I confront her she denies and when she said what she said about my parents that was the last straw and i finally said something and her mom kept saying my friend would never say that and that she is 100% positve she didnt say that. How would she know she wasnt there. Thats the main things that brought on the fight but she has said things for like a year and I never confronted her about it I let her walk all over me but once it invloves my family thats it . Please answer my question and not worry about my one piece of drama out of the whole year I hate drama and want no part of it I was just wondering if it was illgal please answer that. Thanks. and I know were has no H i was typeing fast and it was a typeo.

The conversation can not be used as evidence in a court of law. I don't know what the lady hoped to gain from recording the conversation other than to create more drama. Some people are hooked on drama and they actually do what they can to create it. Run as far away and as fast as you can from these types. They will suck you dry.

It depends on where you live. Some states require the consent of all parties to the conversation to record the call without a warrant. Most states do not have this requirement. California requires the consent of all parties. See the link below for more information.

Where do you live? It depends on the laws there. Even in the United States, laws differ from state to state. In some states it's legal if one party knows it's being recorded; the other doesn't have to know.

California regulation does not enable tape recording of telephone calls till all events to the communique consent (California Penal Code 632), or they're notified of the recording by a different "beep tone" warning (CPUC usual Order 107-B(II)(A)(5)). even with the undeniable fact that, tape recordings can legally be made if somebody or contributors of one's family members are threatened with kidnapping, extortion, bribery or yet another legal related to violence. the guy receiving the threats could make a tape recording without informing the different social gathering. (California Penal Code 633.5)

It depends on the state. In some states, only one person (that would be friend's mom) needs to consent (here present, since she did the recording). In other states, both parties must consent. Either way, its sure a lousy way to try to be human being.

it depends on where you live, in some states only one party has to know about the recording ie the person doing the recording, in some states both sides have to know. in all states (i think) a warrant has to be obtained if neither of the parties knows about it. ie police tapping's and things like that.

From what I know, it's illegal without the express consent of all parties involved. However, as your parent, she has certain 'liberties' that may be taken in order to protect you. Unless you're overage, which you're probably not. (Were has no 'h', just to let you know =). )

depends on the state law, you can check your state guidelines on this at their home page.............and to be honest it sounds like the argument you had has more in it than you have said and maybe the other mother was making sure ALL bases where covered for the future.

the person on the other end of the line has to know he/she is being recorded, i think.
i don't think it's RIGHT to not let your mom know, but the LAW? who knows. check the laws in your juristiction.
