In a roman catholic family, the father writes the Will and he is unable to register the property till his death. After his death the house and land is registered in the name of the mother. However suddenly out of the blue , the mother along with one of the daughters decide to sell the land without informing any of the other children and they are allowed to go scot free. There is no mention of the members of the family in the will, neither have any children consented to the sale. Can this Sale be quashed, as otherwise it would become unfair to some and fair to some as the daughter who has induced the mother to sell the land and house would have pocketed the balance amount besides the registered amount received in White. Can this sale be quashed. Please reply sooon.

Laws about wills and probate are civil and not religious.

Where are you? Are you in the US? the laws of the Roamn Catholic Church really have littel to do with our legal system. Seperaton of church and stated don't you know.

I am not sure why you think the children have any right to decide anything about the property. MOther has probably cared for the property most of her life, It really is her business.

But in the US, generally, unless specifically mentioned in the will the spouse can pretty much do what ever she wants to do with the property. IN the US in the abscence of will, pretty much, the property would just go to the spounse period.

However if the mother, the spouse in not mentally capable of makeing her own decissions and you can prove it in a court of law, here in the US you might have a leg to stand on.

This may fall in certain category , that is allowed in India, it can be contested in civil court with religious interpretation.

Bombay High court has all religious sections in Flora-Fountain Bombay, I have seen Hindu and Muslim and Parsi sections, so it it is worth the effort to see if they have Roman catholic forum available.

Court are their to handle certain things only according to religion,they are :
Inheritance.
Successions.
Divorce.
Marriage.

Other then that there is the separation of church and the government. This in itself shows the separation, as government let you follow the cultural and religious rules when it come to certain things. Generally, these are called "Mama and Papa" wills, when one dies it just goes to the other, no children are usually mentioned.

Does Mom have her facilities in tack?? Can she take care of her
own business things like that? ?



Sounds to me you just have a sister to may be up to no good!
Hard to know, unless she is going to take sole responsibility of MOM? ?

I don't think religion has anything to do with this situation. The house will belong to whoever's name is on the deeds. They are perfectly within their rights to sell the house, if they want to.
