It is their property simply because they have a reciept for it. Is it legal for me to keep it since it was a gift to begin with?

Generally premarital gifts are considered "conditional promises". The gift was contingent upon the subsequent marriage. I think the ring donor will recover the gift if the marriage doesn't take place. However, each state's laws are different, and there may be other circumstances that would allow you to keep the ring. For example, California law says that you may keep the ring if the marriage contract is breached by your fiance, with no fault on your part. Your best bet is to speak with an attorney. Maybe one who specializes in family law.

If you have witnesses that the person gave the ring to you or a card that was included with the ring when it was gifted to you then you should keep the ring. Just having the receipt does not mean that they did not give the ring to you.

You have to give it back unless you have proof, like a witness or a contract. Women have been wanting to keep their engagement rings for years and most of the time it is a no go...Give it back, if that person is such a snot as to do something like that, why would you want the ring in memory of them?

A gift can be requested to be returned if there is no deed of donation as provided for in the Civil Law.

If someone gave you a ring, especially an engagement ring, and they want it back, give it to them.

It should be legally your's but here is what I would do. Flush the ring down the toilet and then I would tell the person, "I flushed it down the toilet that is legally mine."

Give it back. Why would you want to keep something that is suppose to be sentimental when it doesn't mean anything now?
