I was injured after being served plastic sharp enough to impale itself in the roof of my mouth 3 days later i'm in the hospital for five days after having surgery I swallowed smaller pieces that gave me an infection strong enough I could have died. The restraunt made a report and i have four witnesses not including the waitress and manager. so do I hire an attorney from the same state or can i hire one from my home state?

Several people have allued to the correct answer, but none have been completely correct.

You MAY hire an attorney from either the state you live in, the state where it happened, (city, etc) or from some other state entirely.

If a lawsuit is filed, it will most likely be filed in the state where the incident happened. This means that if you hire an attorney in your home state, he/she may not be admitted to practice in the state where it occurred. Then, they will either have to referr you to an attorney in that state, and/or will have to hire an attorney in the state where it occurred to act as "local counsel" so that the attorney can file the suit. This adds cost to your lawsuit.

If you retain local counsel in the state where it occurred, you have the difficulty of communication. They are a distance away, which means phone calls, email and letters to update you on your case.

If you have a local attorney with whom you have worked in the past, I would suggest you take the matter to him/her and then discuss whether to hire counsel in your city or in the city where it occurred. For a referral to a local attorney in your city (or where it occurrred) contact the bar association. Please, don't respond to television advertisements.

Personally, I would hire a lawyer that is the closest to where you live. Since you are as badly injured as you say, a long trip would probably be hard on you and a shorter trip may be easier on you. I think some lawyers will come to your home or any prearranged place that you want. I listed a website below that will help you out. Good luck with your case!

You can hire any lawyer from any state as long as the case is filed in the court of the city/town where the restaurant is located under the Rules of Court.

It depends. You can sue in your home state if the fast food chain has any type of business in your state, i.e. store, business offices, even advertises there.

I think you can hire any attorney that is willing to represent you. Be aware though, they have much $$$$$$ they can use against you and your case.....
