The courts determine custody through a variety of methods, often it's best if the parents of the child come to an agreement about how they will divide their time with the child, through what's known as a Parenting Plan. This covers how the two parents will proceed with visitation, holidays, birthdays, and other responsibilities.

When a person remarries, their new spouse doesn't 'outrank' the parent of the child in any respect where the courts are concerned.

I've had several friends in similar situations to this, and they've worked things out between them quite well. If you're concerned about equality and formalizing the entire process, then it's best that you work things out between you, draw up a parenting plan, and submit it to a lawyer, or have a lawyer work it up.
