my mom andmy dad have been seperated, not divorced, for the past 15 years, and my dad has been paying child support monthly but for the first four years he didnt pay, and my sister just finished high school, and now he wont pay for her now, bc he says he doesnt have to, my questions was, can my mom take him to court and make him pay for those four years? and for the other year he didnt pay after my sis finished high school?

If their was a court order issued and then he didnt pay then yes he will owe back child support. If there was no court order and your parents worked it out on their own then no he is not responsible to go back and pay. Also child support is only the child turns 18 so if your sister graduated high school and was 18 he is no longer obligated to pay anything becasuse she is considered an adult. These are the laws in calif.

I believe it would depend on whether there was a court order in place for those years he did not pay. I have been told that if there is no order, then no, it would be very difficult to get the money. However, I am not an attorney, and may not have the facts correct for you and your situation. Also note that states vary in their laws, so it may be based on that as well. Your mother should be able to quickly get an answer from a family law attorney. Good luck!

He should have had to pay back child support if it was court ordered. He could have caught up since then. In that case no. If your sis is older than 18 and is not attending school, she's an adult and he won't have to pay for support on her since she is technically old enough to support herself.

yes..your mom can get a lawyer ,and he should have to pay,whatever amount he owes...my mom went to the state my dad lived in,and had him arrested,and the bond was set at what he owed,and my brother wasn't even my dads biological son,but ,they were 2gether when my mom had him,and my dad signed the birth certificate...i'm fightin in the courts now,for about 10,000 in back pay for my kid..his peice of crap of dad will pay,i don't care how many times i have to take him back to court..

MY SON IN CALIF IS NOW 18 AND OUT OF HIGH SCHOOL AND CHILD SUPPORT HAS STOPED BUT I STILL OWE PAST SUPPORT SO AS LONG AS I STILL SEND ACHECK EVERY MONTH CAN THE STATE STILL ON TOP OF THAT STILL ORDER FUNDS FROM MY PAY CHECKS AT MY WORK? AND HOW MUCH?

yes as long as you both were under the age of majority, in the state and/or province you live in. I helped a friend of mine go through the same type of situation. So I wish you, your mom and your sister the best of luck

it depends on the state. most states make the parent responsible until the child is 18 or until he/she grads high school. he can also have to pay if he/she decides to go to college.
so the answer to your question is YES
