Simple. It's against the law for them to be smoking there plain and simple. Next time you speak to a manager all you have to do is say that you have contacted the health department, given them your name and place of employment and that you believe those whom are smoking inside shouldn't be. This manager will immediately contact the owner/boss and let her know.....it will then be remedied without you losing your job because they know you've given your name and place of employment. Also, contact your local chamber of commerce and tell them your problem...they will also direct you to more of the right places that will be on your side. Smoking around the food is a health violation - call the local health department. If the restaurant is somehow registered with the health department, then smoking anywhere in the building could be a violation.
Just contact the health dept., or threaten to and see if the owner does anything.

First off considering Ohio is smoke free now you can contact the state and report your restaurant, anonymously if you like. It is now illegal to smoke inside all public buildings. Also you can contact the health department because technically you are not suppose to be smoking around food prep stations (I believe
If you really want to you can talk to your manager and ask for a transfer to another McDonald's

Ohio's Smoke-Free Workplace Act will officially take effect on December 7. If your employer allows the employees to smoke after that date, you should report her to your local authorities. make it clear that you intend to uphold the law if she does not. It is your right.
