I was recently in a auto accident. I am not at fault for the accident. Now I'm in debt. I call the person who is at fault to try to work something out. But he says he can't help me. I guess he thinks that I won't take him to court. When I take him to court am I going to get my money right away? if not how can I get my money quicker?

Just have your insurance company handle it. That is why we HAVE insurance.

Going to court and winning just means that there will be a judgement against the person, it does not mean that you will get your money. As the cash of the Goldmans in sueing OJ, he has never paid them the $37M. If you can get an attachment against some of his personal assets then you would have a good chance of getting your money. Did not the guy have insurance, or did you not have uninsured motorist insurance?

Did yall not exchange insurance information? IF you both had insurance, and the accident was found to be their fault, and not yours, then you should get something from their insurance company. I would not take them to court, unless you were badly injured. Court costs would probably outweigh the settlement, if there were one. So, good luck with that.

Unfortunately the courts are slow. If he is not helping with the damages due to the accident, you need to find an attorney to help you before the statute of limitations runs out on your case.

You can take him to court and possibly win your case. But keep in mind court costs, lawyers fees, etc. And no, you might not get the money right away. He might appeal the case if he loses. And you cannot expect him to pay what he doesn't have. You can sue him for a million. You might win, but he might be ordered to pay it off in small monthly amounts which he can afford. I wouldn't expect a windfall.

This will not be a fast process. You will likely need to file a small - claims action against the a**hole. Once you get the judgement, you will likely have to go after assets and wages with a court order to seize them. You will not get paid fast, but keep after it.

Nope. Going through the same thing right now. The money is owed but no guaranty that it will ever be paid.

I don't understand......did your insurance company pay any damages? Did the other driver have insurance? If the other driver was at fault then his insurance should pay your damages.
