They should of not let your cash the check until it clears. In State take 3 to 5 days. Out of State take 5 to 7 days or more. It not fraud to keep the money. Especially if you already spent it. Some time if you talk to the bank and explain who wrote the check. They will go after them for the money and not you. Unless it is a stop payment. Then you have to sue the person who wrote the check.

Investigate, and hope that you pay them the money if the check didnt clear. If you dont pay the bank will eventually put the account in collections, but they cant do anything to you with the police yet, it may take a month or so if they decide to press the issue and go to the police, but ultimatley they were the ones that gave you the money and trusted your g??d faith!! Relax your cool....for now!

who was the 5000 check from? if an outside source (other than friends, family, yourself) then it should be fine. however if htey investigate and find out that you conspired to cash a check and take the money straight out then you will be in trouble. although, i thought that when the money was put in your account the check had cleared and was good. but they are only wanted to investigate bc it looks suspicious that you deposited and took the money right back out. if the check is from an outside source and u are cleared in whatever investigation they are doing then they will go after the person/company that wrote the check

Who wrote the check? If you wrote the check, they can call the police for writing a check fraudulently. If somebody else wrote the check, they could freeze your account until you put the money back in.
