This is what juries are for.
It is stupid and dangerous to take pictures of nude children that include their private parts with or without consent, with the possible exception of one's own children (even that has led to threats of prosecution -- stupid but true).

Are you kidding me? That's called pedophilia, and it's illegal with or without the consent of the parent. The only diff would be that the parent would be an accessory to the crime or worse if the parent was involved.
How in the world can you ACCIDENTALLY take a nude photo of someone?

I wouldn't be worried about suing them. You should immediately contact your local police or sheriff's department if you live outside city limits.
The criminal avenue is the way to go with this. He could have had every intention of trading these on the Internets.
On a personal note, why have you not beat the sunshine out of him yet?

They can be charged criminally, but I don't know about sued. Probably not sued, because you have to prove damages to sue. You would have to argue that the children somehow suffered psychological trauma for instance.

Could be the tip of child porno--Charges can be filed, a lawsuit? Well, You can sue anyone for anything.
First the pictures were not taken by accident, the accident was they were found. It doesn't make sense that the pictures were taken by accident, and if it doesn't make sense it generally isn't true.

OMG! I don't know about sued, but you had better press criminal charges immediately! Don't let this perv get away with this! If you don't take action now, you may regret it. Please stand up for your kids! As for your wife, if she knew about the incident, she is just as guilty.
