Question Details: I have having problems with employees smoking at a non smoking mcdonalds resturant in Ohio. Its after the dine in side closes and we are a 24hr resturant. I have contacted the owner of the resturant and she wont do anything about it becuase shes a smoker herself. What can I do to protect my self from the harful effects of second hand smoke. Managers allow this smoking also.

Depends on where you are. If there are state or local laws where you work against the smoking that's taking place, then you have a right to complain to that level of government. If there aren't any laws against it, then your right is to look for a different job.

Many states and municipalities, but far from all, have passed laws that smoking in particular places, usually including restaurants, is prohibited. You'd have to check the law to see whether they prohibit smoking in employee areas, or just in the public areas. Most of the laws, but not all, prohibit both.

If, as one of the other responders said, Ohio has such a law in effect as of the first of the year, then wait until then, then complain. If the law isn't in effect yet, you can't file a complaint until it is.

Contact the local health department and ask them to do an inspection during the time the smoking is going on. The restaurant will get a big fine and maybe get closed.

If they are smoking inside the building there may be a law against that. You could contact you states Department of Labor for more info. Google/Yahoo Department of Labor (enter state) or I think the federal department of labor is DOL.GOV and that should have a link for your state. Good Luck!

Ummm OK i smoke cigarettes not pot though. But as-long as there smokein out side on there breaks there's no problem. Smoking inside a house or inside any building is disgusting!

I also live in Ohio, as of the first of the year it will be illegal to smoke at all in any restaurant due to the voting. Call the health department.
