to them because they had to repair the vehicle before it would pass the smog test. I noticed that day that the vehicle was damaged. I live in California-has the Statute of Limitations to pursue legal action already expired? I filed in 04' but had difficulty serving suit.

Nope you are well within the limit, but most all dealers have signs posted about being not liable for damage etc. It's a bad cop out but I bet your dealer has such signs.

Three years later, you are out of luck. This is a case that a small claims court would call frivolous.

Going forward, file your claim or suit on a more timely basis.

(Just so you know, the court would want to see the car's damage, and the defense would say that there was three years' worth of road damage there and they would win.)
