if the fence has been up and property owners agreed to it,now one of them have died .does the line fence still hold up in court?
Where can I find the right documents to support this.

Actually, there are laws pertaining to this. I have no idea what it's called but look for "property rights" maybe "access" "new property lines" in Google. It has something to do with after many years, the rights can be "grandfathered" or something like that. You should see a real estate attorney.

Sounds like an easement by prescription or adverse possession.

Any competent Real Estate attorney would be worth their fee, especially if the fence is not on your actual property.

If the fence is on the property line (established by a survey), and there are no restrictive covenants in your deed, the fence is perfectly legal and "runs with the land."

A new owner cannot make you take down the fence, since it was there when purchased, unless there are specific ordinances that address this, in your locale.

Your county surveyor should have documents.
