I am from India. Does anyone knows how much time it takes to get divorve in India - if both parties agree. Do husband n wife have to live separately for some time - before one of them can file for divorce?

If you are having your divorce (uncontested) here in Canada it takes about 3-6 months. and a good lawyer charges about $900-1000 Can. Yes you have to be separated for at least 6 months in Canada.

Why do U want a divorce. Unless both of u are rich it is difficult to settle everything legally. Otherwise it is difficult. A minimum of 1 year is required. Even then if one party is not willing for a divorce then it is difficult. Also it seems u r a male. Try to reconcile otherwise u can be tried criminally also. Even though u live in USA and ur wife give a complaint in the police station u r finished. So better sort out the differences and try to live peacefully. If both R rich then do what u eant the law in india is like that.

It requires a period of six months
to stay seperately, to make you
eligible to file a divorce application.

In case of mutual divorce as well,
the seperation has to be for 6 months.

After mutual application is filed, the
judge gives a period of 6 months,
to find out if there was a scope for
mutual settlement and continue the
marriage. If there are no re-concialliation,
then the marriage is dissolved on
the appointed day, before the judge.

If you file under 13B , mutual consent , then it should be with in six months , bith party have to sigh the same and apply in front of judge .
But if the same filed by wife or husabnds and the other party decide to fight , it can go upto unlimited years .. that is the great law of india.
