Are they allowed to go into your backyard without permission in Texas? Anyone know?

I know that the City of Plano has been known to peek over an 8 foot fence and make stink over bags filled with leaves. [Plano is one big HOA].
And since recent legislation in Texas gives HOA's greater power than before (they can foreclose on homes now-faster than banks), I would not join a community where HOA was mandatory.
I would suggest you check with the HOA rules that you should have been given as matter of documentation at the close. You may want to talk to your city to see if the HOA's have to conform to some city policies on privacy issues.

No its trespassing. they have to have your permission to enter.
