My lawyer is getting ready to serve my spouse divorce papers. I wanted to know if they are mailed or handed to him in person? And also is there an advantage to me serving him instead of him serving me? If so what?

They are usually served in person. They hire some outside agency to serve the papers, this way he can never say he was not served, etc. The advantage to you serving him, is in some states they look at you as the victim & not the other person. Due to the fact that you filed first. Its more beneficial to you in some cases.

They are handed in some states and mailed in others. The only advantage to you serving papers first would be if you had children, then you would get custody until the court hearing.

Depending on the state you live in.. my divorce papers where mailed to him and it didn't make any difference that I served them to him. Best bet is to ask your lawyer.

In most states, they must be handed over in person. I don't believe there is any advantage as far as who serves whom in the grand scheme of things.

If you have a reason to question he will try say that he didn't receive them, have them sent by courier. Because he would have to sign for them. However, if the the divorce is mutual you don't have to worry and can have them mailed.

In Indiana they are mailed and a sheriffs deputy tries to deliver them in person. If the person isn't home they rubberband them to the front door. I wouldn't want to serve them to him myself he might get very angry.

they are mailed to him, if for some reason he says he never recieved them, they will be served on him by hand.

Usually, your husband's lawyer will take service for him. It's the easiest way, and they are delivered in person.

Depends where you live. Here, in WI, they are mailed.
