The first respondent was on the right track, until he started quaffing the kool aid. The (United States) Constitution indicates that the government only has those powers that the Constitution gives it or which are obviously implied by it, and no others. See the 10th Amendment: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved for the States respectively, or to the people."

If the Constitution doesn't grant a power to the Federal government, the Federal government doesn't have it. Other nations have constitutions which take the position that the government can do anything it wants, except what it is explicitly forbidden to do. Ours says the government can't do anything, except what it is explicitly authorized to do.

The competition between the various branches of government helps greatly to keep officials from exceeding their power, as another respondent said. See Federalist No. 51 by James Madison. Unfortunately, that other guy was right in that the government has been exceeding its authority (though I'd stop far short of saying the government itself is illegitimate)

There are 3 branches of government that keep each other in check. Congress keeps the President in check, the President can keep the Congress in check, and the Supreme Court can keep the other two in check (strike down a law if it does not conform to the Constitution). That is the very simple version.

They specifically enumerated the powers and responsibilities of the government, and it was intended to never exceed those specific duties. Unfortunately, it exceeded them long ago. The constitution nowadays is just for show. The current federal government is completely illegal and unconstitutional, and has been since the 1860s.
