How common is it for a judge to award a closed-end period of disability without a hearing? My relative has an attorney, and is currently waiting for a hearing. It is for a closed-end period of disability (one year totally disabled) and the claimant is now back to work. The attorney says he is going to write to the SSA to try to get a decision without the need for a hearing. I was just wondering if anyone else had a similar situation where they didn't have to have a hearing and were successful. Thank you!

I've just been through this. If he's back to work, he probably doesn't have a prayer. I was told, if you're working, you can obviously work. He might be able to get something for the year he was out, but I wouldn't bet on it. They make their own rules. And they keep on changing them. Good luck!
