"The constitution" -- this must be upheld by the Supreme Court and that is ruled by judges, who are put there by the majority largely to defend and rule on what the majority wants. Also, you can amend the constitution, changing it to be what the majority wants.

So that doesn't really work, does it?

The US constitution and the bill of rights.

To amend the constitution, you need a super majority in the US senate, plus you need ratification by 3/4s of the states. Therefore, it requires a HUGE amount of effort. Whatever becomes amended is supported by MUCH more than just a simple majority.

Regarding judges, they are put there to interpret the law, and for the most part they do a decent job. The US supreme court has done well at overruling those activist judges who don't adhere to the written law.

John Stuart Mill wrote about "The tyranny of the majority" though. That's exactly what you're talking about I think. Check out his book "On Liberty."
