I worked in Finance for 2 months in a Temp-2-Perm role for a blue chip company. My agreement was for a 4 month contract which would be then reviewed and possibly made permanent.

Having done a good job, meeting all my deadlines I was shocked to get the sack simply because I had one days leave with flu.
Despite being ill, and sitting at my desk with my coat on still shivvering, I worked Mon,Tue,Wed and Thurs as it was month end and would leave the company in the lirch if I took time off. But after getting all the month end tasks out of the way, I phoned in sick on the Friday at 8am. And my boss said it was okay, get well soon, etc.
But then his boss phoned my recruitment agents and told them to tell me never to come back.
I feel this was totally unfair and wondered if they can do what they did. I fear now as it may affect my future prospects.

If this had been a contract with the company, then you could have sued for breach of contract and they would no doubt have been glad to settle out of court. The problem is, you were subcontracted and your agency was the employer. Just put it down to experience. It won't show up on your cv and you wouldn't want to work for such horrible people anyway.

The problem with temp jobs is that a company can let you go at any time and for any reason. My opinion is they need to eliminate all temp services but that is not going to happen. More and more companies use temps because it relieves them of having to pay the insurance and taxes on the employee it gets them out of paying certain benefits (holiday pay IRA medical etc) and when it gets close to time for the temp to be evaluated and or go permanent the company will usually let the temp go. Even the absolute perfect temp is not safe from this all the company has to do is "terminate the assignment" It is a catch 22 most companies do not do straight hiring anymore so you have to go through a temp service but going through a temp service is risky for the temp to actually get the job. I have been with companies that have had temps who have been working for them for 9months up to a year and still had not got hired permant being told the company had a hiring freeze. Of course the company wasn't hiring it was fully staffed with temps who they could let go at any moment and because you are a temp you do not qualify for unemployment because the temp service is your employer and they will just find you another company to work for.

What does it say in your contract? It was totally unfair to sack you for being ill especially if you had suffered all week whilst working but as a temp you do not have the same rights as a permanant employee. However if you have got a signed contract there should be something in there about what to do if ill, take it to a solicitors see what they say. Good luck

You have no rights. Thats why i will never work for agencies. Its time people formed unions again. I've always been a member. Sometimes when things are going bad at work i often mention the union and suddenly the problems seems to dissappear. They are not as strong as they were but come in handy sometimes.

Unfortunately yes they can.....actually in the united states, jobs are "at will".......which means the employer can fire you at any time for no reason at all, but at the same time you can quit at any time for no reason at all. So being a temp doesn't give you any different "rights" as we actually have none at all in this area to begin with.

Check with the local union if there is one. Otherwise, temp employees do not have many rights to retain employment.

you should check with the temp agency. sometimes a contract exists between yourself and the temp agency.

you really don't have a leg to stand on you cannot sue after only 2 months and at that point you were only agency

you have each and every suitable to ask for explanation of her motives, particularly in case you experience they have been unjust and untrue. Be polite once you ask nonetheless, in any different case she won't experience obligated to permit you comprehend.
