An employee gets a verbal and written warning for sleeping on the job and 3 months later is still sleeping on the job, we're talking anywhere from 10 min. to 1 hour at a time. Employee get fired, stating she had three months to get it straightened (employee said it had to do with medicine which makes her fall a sleep and now she is applying for unemployment . I FEEL THIS IS MISCONDUCT AND SHE SHOULD NOT BE ENTITLED TO UNMEPLOYMENT

I agree.

She should not be working if she is on meds that make her
fall asleep at work.

She is endangering herself and co-workers....even for
something as minor a pouring a cup of coffee could be dangerous.

Sounds like you need to begin having mandatory 'pee' tests.

If she is fired while on meds under doctors care she is entitled to the unemployment "warning or not" I know it sucks !
I was fired for about the same reason ( Broke my back in a fall), after 9 months of rehab and 3 days back on the job (under doctors care) I was let go cuz of my meds.

Whatever, really if america minded their own business this world would be a much happier place. She is not cheating you out of anyting and she has contributed to her unemployment benefits and for the amount she is going to get really it's not even worth the time you spent asking the question. Dude get a life.
