a family member of mine has had some one call Child protective services on them and (cps) is trying to have her voluntarilly place the child with someone else... The problem is there are so many rights i can see that (cps) has already violated of hers that i need to know more of what she can do to protect herself, and what they are really capable of doing with out a court order. They have made a ton of threats and have yet to make a legal court order.... She is being pushed into all kinds of desicions by them, and her case worker is verbally telling her that she has no choice and is admitting to her that these are threats....

Try to get a lawyer who will handle them.

Tell her she can tell them to take a leap! They have no authority to make her do anything, especially "voluntarily" place a child!

They are capable of nothing without a court order!

There is something to be said with cooperating with CPS if they are seeking a person some help and it will preclude court! That doesn't mean to run roughshod over people!

Another reason the usually use voluntary is they don't have to pay for it!

If she feels they have no case, I would tell them to take a hike! If they do file a petition, unless the child is in imminent danger, a judge will not remove a child! She will be appointed an attorney and the child a GAL or CASA worker!

Sounds like they are bullying her! She should ask to see their rules! When a law is written an agency has to write rules, which carry the same weight as law! If they have not written them, their policy is worthless!!

Read the law, and if you want me to I will! They are pretty much similar as they were written in the middle 1970's using a federal formet!

I investigated child abuse for 16 years! I testified against the State of Florida as an expert witness in Belamy vs HRS! Broward County Hospital had already settled the suit against them and their Md's!

It was a shaken baby case where the worker claimed she saw the child but never did! The kid was brought twice to the hospital who misdiagnosed him! The next time they saw his brain was so damaged he can do little

Anyway, Florida lost 12 Million dollars!

Be very careful when dealing with Child Protective Services (CPS). These people are an out-of-control agency that kidnaps children and markets them for adoption, all for federal funding profit. They have a long history of committing some of the worst human rights atrocities this country has ever seen. All of this under the guise of "protecting children" and "providing services to families in need of services". The family courts are not only of no help, they are usually in collusion with these criminals. Having seen this before with a family member, it seems as tho CPS has complete autonomy in what it does and to whom. She needs to speak to an atty NOW, esp if they haven't yet removed the child. She should, in the mean time, jump through the hoops and hope that the child is not removed. She and the child will have their own atty appointed by Family Court but it is better to hire one if you can afford it. Hopefully, she has a lot of family support that will stay around for the long haul and, believe me, it will be a long one. Good luck.

There is an organization dedicated to educating people about their rights. They get extreme, but they have a lot of good resources.
