someone i know is wanting to go into the medical field and needs to get this expunged before she is allowed to do her clinicals.. she plead guilty to this charge on the advice of her attorney... she was charged with this crime b/c she and her brother took some acid and went to a concert... he wandered off and got hit by a car and killed... they said she was responsible for his death b/c she "gave" him the acid and she was the older one and should have known better... even though she wasn't with him when he was run over... crazy i know... but it's the truth... she's 23 now and this happened when she was 17... so... can this be expunged? under the circumstances?

she was charged as a juvenile... then had a transfer hearing b/c the DA wanted to try her as an adult (even though the incident happened while she was a juvenile)... the hearing resulted in a transfer to adult court... she was charged and convicted as an adult on this case...

You don't say what state you are in, but I would say probably not. Reckless homicide sounds like a stretch, but it is mostly appropriate. She was charged as an adult because of the seriousness of the offense, and a juvenile is considered 16 and under for criminal offenses. Besides, how many people would want someone treating them that had been responsible for that, no matter how old they were when it happened. I feel bad for your friend, but people have to live with the consequences of their actions and choices. You may want to have her check with a lawyer.

Only a lawyer can answer a question like this. No one can give legal advice unless they are a lawyer. I would refer this to an attorney. With the nature of the homocide this may or may not be held against your friend, even though she was a juvenile at the time. It depends on which state or country she lives in as well.

It's worth the money to get a straight answer from someone who is qualified to answer.

Doubtful. Depends upon the jurisdiction you're in. Was she charged and convicted as a minor? Then the record would be sealed but not expunged. If not, it's there for good.

I know a friend of mine who stole a car with 4 others and wrecked it killing the other 4, he however survived and was put in afamily group until he turns 21, he is 16 I think, I'm 2 years older then him so he's a minor that's probably why they put him in a group home.
