I might be involved in a situation where I do not receive my money back despite a gaurantee to have it back? The amount is less than $5,000. Is this sufficient to bring them to a small claims court like alot of the tv court shows, Judge Judy, Judge Mathis, etc?

A case could be filed in the small claims court of the city or town where the complainant resides and it is valied unless the parties agreed in writing that a spefic court must try the case.

You can take the company to small claims court, but the limit is usually $3000. If you are owed more than that you need to take the company to a regular court.

If you made the purchase in a different state, you may have to file in that state. An out of state court may not have jurisdiction. You can call the small claims court and ask though.

I don't think you can---because you reside in different states there is diversity of citizenship--you can only sue in the federal court system.
Check the Federal Rules of Civil Procedure

Put it this way, apparently you can sue anyone for anything in the US so go for it
