Since california does not recognise common law marriage, if I went with her to a state for a few days which recongises it and signed an affidavit of support would that be applicable for us. I am trying to know this because we can be eligible to tax benefits which helps us as we live together.

no ,it only goes as far as the state that you are in.if it is not recognized in California it won't work. try marriage because then you can get more benefits.and if anything happens to either one of you( if one of you go in the hospital )you won't have a say in any of the treatment options. good luck.

YES...all marriages..common law or otherwise...are recognized by all states regardless of the state they were created in. It gets a little tricky with same sex marriages, but here is a site with info that might be useful. It might take more than just a few days, though, depending on the common law marriage laws in that particular state. The second link is a list of states that recognize common law and their legal requirements for such. I would imagine, however, that you would have to be considered a legal resident of that state before that state would recognize your marriage, if that makes sense.

Yes I agree with people get married and enjoy the benefit out of it after all you're already practicing as such.

Just get married and quit being afraid of commitment. Get over it. You want the perks without the commitment and it is detrimental to your relationship in the long run. You're doomed.
