My cellphone fell off my jacket a couple weeks ago at a johnny rockets about 15 min later i realized i'd left it there and i went back to the restaurant. I asked the manager on duty and the waitress and i frantically looked all over for it. No one else had seated where i was (per the manager). I asked our waitress and flat out in my face she said she had not seen it and told me they would reach me if found. Well, i went back after cancelling my phone and all and asked again if they'd seen it. Another waitress told me our waitress had taken it and provided perfect description of the phone and all there was in it (pics etc) and told me she no longer worked there (2 weeks after) and that she didnt turn it in (she stole it) I have to talk to the store manager now, but now that i have witnesses and possibly a security tape...can i press charges for theft if she won't respond or give it back? Thanks!

Damn right you can.
Whether the prosecutor will take up that charge is another thing.

i would think so. are the witnesses willing to testify on your behalf?
