Hi, my name is Eunice Saunders and I am an Insurance Agent. Yes! The landlord can be sued because he is liable for his tenants and for anything that occurs on his property! That is why landlords have property insurance with high liability limits. The tenant with the dog would be the primary person in the law suit and the landlord would be the secondary defendant. If you have been bitten by a dog in this situation go see a good lawyer. If you are the tenant or the landlord go see a good lawyer and call the claims office of your insurance company and report the loss. Most insurance companies would settle this type of claim before it ever hits the court system! Good Luck. Eunice

You're talking about a tort, more than likely a case of negligence.

The first thing you'd have to show to go after the landlord in a dog bite is that the landlord owed the one bitten some duty.

I think that's where it fails. You can't even get to the other elements of a case without that. The landlord simply isn't responsible for protecting anyone from a tenant's dog.
