My abusive ex has asked the court for a guardian ad litum for my 2 month old son because there is a record of abuse with police and mental health professionals and he has drug problems why would he do that? Will this person really side with him, because I just wanted supervised visits for awhile till he can prove sobriety...

Because he wants an independent person to make the determination.

I'm casting no judgments on your or him, but the facts are anyone can say their former spouse is abusive and anyone can say they are a fit parent.

The guardian ad litum is responsible for looking out for the best interests of the child, and is not on the side of either parent.

He more than likly asked the courst for this, because he loves his child.
But if he's as bad as you make him sound, he's in denial that he has any of these problems.

You better pray they don't side with him. You never know what kind of mood the judge is in, or if they even really care who they place a child with. OR if at one time, they got screwed by a woman, and they refuse to side with women any more.

Good Luck. IF you have all the proof of your accusations, then make sure you have them in court!!

the guardian is for the child, this person will be on the side of what's best for the child. he will take into account everything, husband's problems. usually whatever the guardian says the judge goes with. he is there for the rights and welfare of the child.
