Pretty much. However if you don't already have a price on your head and you MUST have the sword and the armor, kill him, hide the stuff in one of your houses (provided you bought some), than pay the penalty or do the time. After that you can wear it without any trouble, something you couldn't do in Morrowind.
P.S.: Be careful not to attack a named character: he either won't die, in which case you'll lose money for nothing, or if you do kill him (less important npc) you may forfeit a quest. Also don't kill many soldiers at once, as there is only a certain amount of bounty you can repay. Alternatively, and provided you have a pc version, press ~ then type player.setCrimeGold 0 .That way you reset your bounty to 0. You can also change the disposition of the npc's towards you by using player.setPCInfamy 0

In Oblivion you can do anything, just pay the hefty fine later, or go to jail and lose some skillz.
Only if you're the Gray Fox, the guards will kill you without giving you a chance to pay up or go to jail.
