and how can it be determined if an item is in fact protected by copyright?

All items are copyrighted upon their creation by their creator. They are the ones that have the ability to say how something is to be used, copied or distributed. The copyright holder can sell it, give it away or protect it.

It is illegal to claim a copyright that you do not own.

A certain amount of copyright protection arises automatically when you draw the copyright sign. the problem is proving it. That is why you go and register your copyrighted materials, known in law as "perfecting" your rights.

There is a website that lists patents, copyrights and trademarks. It is a .gov website, but I don't remember the name.

Copyrights are recorded in the Library Of Congress. However, if you have substantial proof that you have originated a work, you have a copyright.
