Judge grants joint custody in a temporary hearing. Visitation is scheduled until the OSC. Work schedule has changed. Can one parent pick up the other child a few hours earlier than scheduled from the sitter if the other parent is at work with joint custody rights? or can the other parent call the police for a violation?

the reason why i asked is because the order was set at an ex-parte hearing. and just to be a moron the other party will make me wait those 2 hours even though they are at work. what i am looking at is the right to pick up my child who is not in school from the sitter as the other parent is at work.

What the two parents agree to together will almost always be honored by the court. In other words, call the other parent and work out the details together. If that won't work, then the legal thing to do is to schedule and Ex Parte Hearing to explain the changed circumstances to the judge so that he can make a decision in front of the Order to Show Cause. An Ex Parte Hearing is granted for emergency reasons when waiting for the scheduled hearing will cause unintended/unexpected problems. You have to notify the other party of the meeting so that they can be there, but it can be set up in a matter of a couple of days.
The best thing is to work it out with the other parent.

Hopefully your judge will require you both to go to Parenting Classes through the court system. Being petty for a couple of hours is insane. Yes the cops can be called, but why? Giving in a little bit is so necessary when people are co-parenting. Not every schedule is going to mesh. Please consider trying to get along a best as possible for the kids. If the other parent is the one who won't budge or bend, ask the judge to put you both in the parenting classes, I went through it. It is free and very informative. I also live in CA.

Yes, the other parent could be a butt and call the police.

If the custodial parent wants the non-custodial parent to pick up the child, have the custodial parent write and sign a note stating that fact with the specifics...date, time, location.

Always cover your self!
