This is why people hate cops. I'm a law abiding citizen, but I REFUSE to let a cop into my house for ANY reason. I won't have it. They can come into the yard, and I'll meet them out there to "talk". When I build my house, I will have a "recieving area" in the front that will not have a direct entrance into the rest of the house.
Sorry if it offends the good cops, but just like the criminals don't wear badges that say they won't resist arrest or aren't armed, I won't know if it's a dirty cop using sly tactics to set me up, or if it's just a legitmate conversation about what's happening.

It kinda depends on what they picked up your friend for. The money might have been taken as evidence, particularly if your friend had a warrant for something like drug dealing, or something else where the fact that he's got lots of cash lying around could help prove the case.
If you let a cop into your house, he can look around, and if there's something he notices, he can check it out (which is why you don't let them in without a warrant). However, to start going through drawers & stuff, he should have a warrant. If not, it can be argued that the whatever evidence he finds was collected without a warrant, and is therfore inadmissible as evidence.
Sounds like your friends need to find a lawyer...

It does not sound reasonable to me. The cops could have taken the money if they had reason to believe it was from illegal actions, such as selling drugs. From your description, it did not sound like they found drugs or the girlfriend would have been arrested as well.
The sad part here, it will probably take an attorney to get the money back and that will take time and money.
The moral of the story, do not invite a police officer into your house unless you NEED a police officer. Be polite about it but refuse to let them in unless they have legal reason to come in. Even if you have nothing to hide and nothing illegal. A big pile of cash could look like it came from something illegal and cause a problem like this one.

I wouldn't count on her getting the money back before it is time to move. She definitely needs to go to the police station and find out what the charges are. If they are not drug related or something they can use to keep the money by default, then she needs to put in a request to get the money back. Hopefully, she can explain to her landlord what happened and see if she can stay in the apartment if she is able to come up with the money for rent. Otherwise, she needs to be looking for a place to stay in the meantime.

To little action too late. You should have retained a lawyer on day one. Nothing will happen in three days and the longer you wait to put some pressure on the PD the braver they will get. Contact every media source you can, and give them the human tragedy side of the story. Make sure you have all of your facts straight and see if you can get any results from the public outrage.

1) She let them in. Thus, she gave consent whether aloud or implied.
2) She needs an attorney in order to settle anything else.
3) She needs to make sure she holds on tight to that receipt.
4) She needs to choose better boyfriends.

that alone is reasonable cause for a search
if you have over $1000 in cash in Calif. and can't prove how you made, it though check stubs or bank statements
by law it is considered evidence of illegal activity.

She should have contacted an attorney the day it happened or he day after. She probably screwed now. I would still however try to get a lawyer.

The police entered with her permission as you sstated they wanted to "talk" and since they found nothing there was no reason to take her money and you need to get it beck go down to the police station and ask for your money out of the property room
