My neighbor is harassing me. I am going to get a restraining order against him

. I own my townhouse and the harasser rents. The property management company won't do anything and neither will the property owner.

I want him out of here. He verbally harasses my family and flattened all of my tires this morning.

I live in California and am wondering if thier is any legal action I can take against the property owner.

All suggestions welcome

Go see a real estate attorney and tack on as many other things as possible into the law suit. Not to be a jerk, but it is often the only way to remendy some situations, but I just like to sue people too.

As a property owner in Ga. I have 10 rental units. Have been in this business since 1988. I hate to tell you this but there is no recourse against the property owner in a case like that because a property owner is not and really should not be held legally responsible for what a tenant does on that property. The reason I say this is because once the property is rented or leased the property owner has no control over what happens on the property. It legally belongs to the tenant until that contract expires. IIII wish it was different! A bad tenant has cost me a lot of good ones. Unless it is specified in the contract. Your first option is to go to the rental company. if that fails go to the property owner. To be honest neither the rental co. or the property owner can legally do anything except talk to them. They have one other option and that is eviction. Even then they have to have a legal reason to do so if they want them out in a hurry. Otherwise they have to give them an extended time frame in which to move. Especially if the tenant has a rental contract. It depends on if that is month to month, or how long the agreement is for. If they have a lease you're screwed. If the tenant were to break that contract or lease in some way then the owner could do something. In that circumstance all you can do is take legal action yourself. If you have a camcorder or even a tape recorder it is always best to have some type of documented evidence. Short of that get yourself some witnesses that will testify. You can check with your local magistrates office to see what that entails in your area as the laws vary in different states and counties. I have been through this a million times. My son is an attorney here in Ga but I learned all of this from a crash course (extreme experience.) Since you own and they rent sorry to say, you're in the worst situation since you can't just move. LOL

Keep records of everything. Take pictures and keep everything as detailed as possible. If he's flattened your tires that means he is trespassing as well as destroying property...both of which are obviously illegal. His behavior is also having a negative impact on you and your family, which can affect work performance, etc. Bring this up when you speak to the judge. Definitely get a restraining order.

Find an attorney. I don't know the specifics, but I'm positive the property owner can be held liable. He has this person under contract and that person agreed to certain terms. You have a right to be safe on your property and that is being infringed upon. I would sue for damages.

If you have a flair for drama, there are always those cheesy tv judge shows as well. I always thought they were silly until a friend went on one and "won" his settlement, without costing him a dime in legal fees.

Depending on what the property owner has submitted to all residents living there explaining what he will accept responsibility for maybe something probably nothing. this neighbor of yours isn't going to stop because of a restraining order. so here's what you do. after getting the order against him go to wal-mart and look for a security camera system called homeland security.
its a 2 channel system meaning it will monitor two different cameras with sound. get the two cameras with night vision capability the whole system plugs right into a VCR. and you video tape the bastard violating the restraining order and have his sorry as thrown in jail.
by the way the whole system should cost no more the 100.00

Yes, the first thing to do is file a written complaint with both the police and the property mangagement company so that you have a "written"record of the problems. Then set up a video camera(with audio if possible) of an area where you know that your neighbor will show up....maybe video tape the area where you park your cars? That way the next time he does something you have physical proof and can have him arrested.

destruction of private property.... call the cops. call them every time. irritate the hell out of the cops with your calls. it's the only way to get anyone to do anything. do not relent. i would get myself some kind of protection, because this is probably going to piss him off even more. he sounds crazy to begin with, so you never know with the crazy unpredictable type. the restraining order is good. as much documentation as you can, if you want to take the legal route. you might not be able to do anything with the property owner but if he damages stuff of yours, you can sue him. of course, there's the matter of proving it was him....try. video tape him, witnesses, etc. god, i hate people like this and really wish i could do more for you. be cautious, please. but do not be afraid of him. cautious as in, don't do stupid things to leave yourself vulnerable. ever watch a lifetime movie?

Make sure you always file a police complaint. That is your proof so that when or if it goes to court you can show that you have been harassed.

Most towns and cities have ordinances stating that you have the right to enjoy your property in peace or something along those lines. Check into it.

Sue him for abuse and harassment and be sure that you have all your reports and take pictures and video's if you can. If you have a video of him harassing you or your family put it out on youtube.com so he will see who he's harassing in the future:-)

Call the police every time they do something. Also try videotaping any encounters you can. Have you talked to a lawyer?
