i have told my husband he has until march to find a new place to live because the marriage of four months was a mistake and he said well if you think i m just gonna sign your wrong, ive spoken to my lawyer and he says he will get nothing and that i shouldnt wait to get the divorce filed. has anyone had the problem of their ex not wanting to sign and it doesnt matter if they sign right? you can still get the divorce.?.there are no assets or children between us.. he has no vehicle, a poor paying job and very few friends plus he is on parole so that is why i am giving him 4 months to find somewhere else to live. i have 2 girls and i have paid all the bills over the last 12 yrs we've lived together and i have 3 animals, it is easier for him to relocate than me, besides why should i move he's the one who won't give even 30 percent into the relationship, he has been a moocher and user for a long time.

There is nothing to sign anymore. You file he can try to contest but won't matter and with no assets 6 months later you should be divorced. At which time you can call the police and have him escorted out because this would have been ample time for him to find a new place to live. Just make sure you request that he moves out in your divorce decree (and you only have to do that if he is on your lease)

if you file for a divorce (it's too late to annul) your lawyer or you will have to find someone to serve him the papers. they will state that he has a certain # of days to respond. if he doesn't sign yes to the divorce or doesnt' respond at all the courts will take it as he doesn't care and grant you a divorce. however if he signs and says no or refuses to be served, you may have to go to court and explain to the judge why you don't want to be married to him anymore. since there is nothing to be seperated between you two, there should be no problem and if it goes to a judge, he'll probably just find the guy to be a pest and grant you a divorce anyway. good luck and if he doesn't leave, you can have the police come and escort him out. that's how it works. he you fear him, get a restraining order first before you have a cop come and see that he takes his stuff and leaves.

Why don't you both try marriage counceling instead of divorce, and actually try and resolve these conflicts. Don't let this world influence you by saying that if things get tough, just split. My wife and I have been married for 10 years now, and it hasn't been easy. We almost got divorced and we have been going through marriage counceling for about 6 months, and it has really helped us out alot. And by being able to work at our differences and it's made a big difference.

The problem with our society today says that if your not happy in your marriage, divorce and find someone else who will make you happier.

When my wife and I got married, I took our vows very seriously, and I think that if there are differences and times get tough, you have to work at it to resolve these issues.

Go to his parole officer tell him what you told us and he'll be out.
If he is on parole he is suppose to have a steady.job. You can get the divorce whether he signs or not , you know he doesn't have the money or a steady job, File for divorce have him put out and put a peace bond on him, he is using you for a place to stay and eat. Let him go a shelter, that is where most bums end up.

you are totally right in your way of thinking i agree with you . yes there will still be a divorce even if he does not sign the papers and when it comes time for him to relocate and he wont then get the police involved and make him move cause with my expieirience they do not leave on their own . i had to do the same thing with my ex. yes was paying all the bills too. good luck and god bless and happy thanksgiving.

After 12 years, why did you marry him? I can't figure that out! But anyway, my sister just made the very same mistake, and no it doesn't matter if he signs anything.

Yes but you married him, and of course he is not going to give up his free life style for nothing, the only way you will get rid of him is if the police come and drag him away. so I guess you need to put all you wants in writing and go to court

he doesnt have to sign, but it will cost you more because you will have to fight in court, and he cant afford that either.you have to make him want to leave...........start dating openly in his face, put him on the couch.tell him you will call his parole officer and start causing trouble for him if he wont set you free.stop buying food and eat out everynight.
