I was recently working for a mexican restuarant as a waiter. I made at least $40 on one day, but only got $10. They say it is all my fault and the computer never makes mistakes. Also, I was told that I would get my credit card tips on my check, but they aren't there. I worked for three days and quit because I was getting screwed out of the money I know I made. what can I do?

1) Document everything
2) Write a letter to them with the information detailed with dates - requesting to meet with them to resolve the matter, with a deadline for the meeting, note in the letter that you have consulted a lawyer would like to resolve the matter with one if possible.
3) Check into small claims courts

Or you can take the pissed off aproach and send them a letter and tell them if they don't pay-up, the unethical treatement of you will be reported to the BBB, show up in papers and you might decide to picket as well.

Either way the letter with details is the most important as well as consequences if they do not follow-up with you. Make sure what ever consequences you set - you follow-up on.

In some states the employer is not obligated to pay you for your first 8 hours of work if you quit your job. It makes up for the wasted time, effort and expense it took to supposedly train you.
Somehow, I feel that if you'd actually earned the money that you would have received it.
