As a smoker well aware of the potential hazards of being one, I think it's proper that others have the right not to be subjected to my poisons. Sometimes it goes too far. A law was recently put into motion in my town making it unlawful for persons to smoke anywhere on hospital property even within the confines of your own car. I don't spend any time in hospital parking lots as a rule and so I guess it really doesn't matter to me. Still, it seems extreme.

I don't see how it could be unconstitutional. There is no inherent human right to smoke, and while employers or the government cannot command people NOT to smoke, an employer or the government can place reasonable restrictions on WHERE smoking can occur.

I doubt it, why did you find something in the Constitution that would lead you to believe that it is? I'm a non-smoker and am glad that I can sit outside at a restaurant and not have to taste second hand smoke with my salad....in some places anyway.

You could make an argument because the Bill of rights says we have the right to pursue happiness.

However the good of the people as a whole sometimes
means that a minority get the shaft..

If a good lawyer was available the 9th amendment could be used to argue the right to smoke.

absolutely NOT. I am a smoker, I choose to smoke, I will deal with the consequences of my decision.. no one else should have to suffer for my decision
