I work two jobs (one full time and one part time) and with my medical conditions I miss a lot of work per month. Will they garnish both of my paychecks or can they only do one? I have been sending this lawyer checks for $10 - $25 per month what I can honestly afford to pay this debt. I'm also in the process of paying off my bankruptcy lawyer to get the case filed in court (They don't know this). Do you think there is a chance that if I call the lawyer they will work out something with me so my paychecks don't get garnished? My mother did this once with her's and it worked. I'm just worried because I'm going to honestly end up on the streets in about two months if I can't stop it. Any suggestions here please?

Yes, you can have multiple paychecks garnished if they have a judgement against you. You should hurry up with the filing of your bankruptcy case so you don't keep wasting money paying on a judgement that will likely be eliminated in bankruptcy.

WHOA! First to answer your question - can 2 be garnished at once? yes. However it depends on the amount you make at each job. Only "x" % of your wages can be taken over a certain amount that is totally exempt.

BUT the WHOA part is this --- if you are paying an attorney to file a bankruptcy petition for you - you have "employed" the attorney. Tell the creditor that you have filed. Have the attorney contact the creditor / creditors attorney to get the garnishment stopped immediately.

ALSO - any money paid to the creditor within "x" days or months prior to filing bankruptcy is subject to be reimbursed to you. You have to ask for it to be, they won't just write you a check. Have your attorney address this issue for you.

Depending on how much you still owe the attorney - you might want to consider whether you might qualify for Legal Aid to file your petition for you. They generally will do so at a greatly reduced cost for those that merit the need. Sounds as though you might qualify based on the illness & lack of funds.

Ask your organization. they could have provided you with a reproduction of the garnishment order on the time that they began pulling money out of your pay. A garnishment demands a judgment against you, so whoever sued you effectively is the main in all threat wrongdoer.

the best thing is to keep in contact with these people. Most of them are will to work out a deal with people who contact them in an attempt to repay a debt.
