I signed for a certain gym contract, and a few weeks later chose to change the contract. The sales consultant amended the contract, which I signed, but I have since discovered that the second contract was fraudulent. The sales consultant sold me a contract that was non-existent and pocketed the money himself. The gym is now holding me to the first contract...is that legal?

The first contract will bind you because it is the legal contract. With regards to the second contract, you can run after the sales consultant because it was responsible for the fraud. Anyway, here is your second remedy, you can force the Gym to respect the second contract since it was made by their employee. The Gym must be the one who will run against their sales consultant.
