Lets say a man kills another person, but gets shot or something happens to make him go into a very long coma, by the time he wakes up. They already have all the facts and know this man did it.

Would this man go to trial? Or just go straight to prison?

Innocent until proven guilty in a court of law. He'd get to have his day in court.

He would have a trial...he could not have had one before because you cannot try a person who is uncapable of understanding the trial and contributing to his defence..therefore no trial or tribunal could take place...amd no conviction could ever be made...

the system is in place to essentially protect 9 out of 10 guilty men in the effort to preserve the rights of the innocent....it may sound stupid..but what is worse...9 guilty men going free or 1 innocent man being imprisoned or killed???

He'd have to have a trial first. You know, all that about "due process."
