mother let him go. it says specifically that the mother has custody during the school year. could she get in trouble for allowing this without the permission of the court first? they live 300 miles apart.

The mother has custody, which means she is in charge of making decisions about her child's living arrangements. She cannot get in trouble for letting the child live with his father. As primary custodian during the school year, she is responsible to make sure the child is enrolled in school, so hopefully arrangements have been made for him to attend school in his father's area...or she could be in trouble if not.

no, if both parents agree to it then they can do it. There are clauses to this that they can agree to change the custody and noone gets in trouble, but, i would think the father would need something in writing from her so that he can get him enrolled in school, most schools need proof of custody but all they would need is something written and signed and notorized from her stating that she is giving him temporary custody for a while with all of them being in agreement to this. Also, if she is getting child support from him, she needs to stop it or for that she can get in trouble for, all she has to do is go to the child support enforcement agancy and tell them that they have agreed that there son will stay with him temporarily and she wants the child support stopped.

No but if the communication got really bad between the adults it would look bad on paper. I'd get something in writing to show this was a mutual agreement and not the mother dumping the child on the dad.

The child if of age has the right of choice as to whom he wanted to live with in case the parents are living separately. This is allowed under the Civil Laws.

Not at all. As she has custody she has rights to make desicions for the child.
