THIS WEEKEND MY MOM WAS PHYSICALLY SIDESWIPED BY A KNOW PERSONS TRUCK. BECAUSE HE WAS NOT AWARE THE HE HIT HER, THE POLICE ARE REFUSING TO PRESS CHARGES. I WAS THERE TO WHITNESS EVERYTHING. HE HIT HER ON PURPOSE. WHAT CAN SHE DO? IS THERE ANY CHARGES WE CAN FILE. CAN WE GET HIM FOR ASSAULT?

Contact you local States Attorney/ State Prosecuter. His or Her office is most likely at the county court house. They will be able to tell you if you can press charges or not and may be able and willing to do it for you. And the great thing is its free. Well, not free. Your taxes are paying for it so you may as well take advantage of it. Free or not, it is a lot cheaper than contacting a private attorney just to find out you have no case.

The police aren't the ones to press charges. Your mom has to press the charges. Do you know for a fact that he hit her on purpose? Sometimes accidents do happen. Your mom needs to contact an attorney as well as press charges. Yeah, there are charges that can be filed. I am assuming that your mom was not injured because if she had been injured, I'm sure the police would have arrested the person in question here. Or, was she in a vehicle when she got hit? In that case, that is what car insurance is for.

I'm not an attorney so this is just what I believe...

Get an attorney to talk to you. Pay for a consultation if you cannot locate one who gives a free initial consultation.

The police are refusing to file charges. Perhaps your mom or yourself could file a 'citizen's arrest'? Check with the attorney about the viability of this. There probably aren't any charges that could be filed with a reasonable chance of succeeding in court. At least not in a criminal court. However, you could sue him in a civil court and possibly get satisfaction. Remember OJ? Found not-guilty in criminal case but still lost the civil action against him.
