Same as if the tree falls on their house and destroys their garage, it's their apple and their mess. It's an act of God. Insurance companies see it that way anyway. If it wasn't theirs...consider raking the apple tree's leaves off their yard.

Where I live it would be the neighbor's apple because it fell on his or her side of the fence. When branches grow over a neighbor's side of the fence the neighbor has the right to cut them to the fence line. The neighbor is also responsible for cleaning up the leaves from that same tree that fall into his or her yard.
