i ask this b/c i observed a case at a criminal court, in where a guy was charged with assault and battery against this taxi cab driver over a fare dispute. The cop came to court and gave his side of the story. Whatever the case is, what is it called? Like John Doe vs. Commonwealth of virginia?

Assault and Battery is a criminal case. The person that got injured may have taken that person to civil court to sue for doctor's bills, pain and suffering, etc.

It could be both. IT could be criminal for the crime but he can also sue for damages.

The civil suit would be Cabbie vs Mean guy
The criminal would be State/Commonwealth/the People vs Mean guy

I don't know about american law, but in canada assault is the criminal charge and battery is the tort .

It is both.
1.Offender could be charged by POLICE in criminal proceedings;
2. Offender could be sued in civil proceedings;
3. Victim can complain to a judge in criminal proceedings
4. Victim can be compensated by the Government [in some countries; for example if assault and battery also involved sexual intercourse; in the Province of Ontario, Canada, the Attorney General; after a long process may compensate the Victims; that is one reasons that in Canada most of women having fraudulent allegations to obtain compensation by fabricating evidence]

a/b is most definitely a criminal case, but you can also sue in a civil court.
